Greetings Listeners,   Welcome to this episode of Tech Net News and Opinion.  This is the full show edition and usually runs about 2 hours in length.  We also publish topic related editions.  Typical topics are tech, Google, net, science, and government news.  When it is close to or during the season of The Walking Dead, we also discuss and review the AMC Show. If you listen to our news broadcasts here, you are very likely to hear stories about patent trolls and “copywrong” as Lumpy uses to refer to the current state of intellectual property law. It has reached the ridiculous point where trolls are laying claims to broad matters such as playlists and podcasting.  This is about as logical as patenting the alphabet. The video below, explains how old law and new tech combined to create software patent trolls.

MegaUpload’s Cooperation Used Against Them

This past Monday, live on the Tech Net News and Opinion, we had mentioned that the search warrants regarding the Kim Dotcom raid had been unsealed.  In our conversation, we had mentioned that numerous sites were reporting that there was no mention of any possible non infringing files  regarding the warrants.

While that is grave enough, an article over at TechDirt adds more stench to the stink.  It seems MegaUpload cooperated with the investigators in a previous investigation of NinjaVideo.  In short they cooperated by not removing files at MegaUpload that were put there by NinjaVideo, as requested by the authorities.  MegaUploaded cooperated only to have the same files used against them when it came time to go after MegaUpload.

I am curious.  Would that be some form of entrapment?

While I do not endorse, encourage or in any shape or form endorse piracy, I extend that “unendorsement” to include any illegal activity.  I also consider illegal search and seizure and a lack of due process equally illegal.  I also believe one is innocent until proven guilty.

You are free to form your own opinion about Kim Dotcom and this entire MegaUpload issue.  I am pretty sure that some illegal activity did occur at MegaUpload.  However, I do not believe that all of the activity was illegal, nor do I have any information as to whether most of the activity was illegal.  Nonetheless, by shutting down and entire server, I am certain people who used the site completely legitimately were harmed as well.

Yeah, you read that right.  I can’t make this stuff up.  GoDaddy, has actually been granted a patent for just what the headline states! I am baffled at what is so unique and novel about this particular idea.  Honestly, who  wouldn’t promote their new web site via social sites and networks?  For that matter who hasn’t done so already?

Being in the news is nothing new for Kim Dotcom.  I recall the YouTube take down fiasco, his song to the president, the raid, and, as almost all of us at Indie Nation News believed, learning the raids were very likely illegal.  If you need to catch up on this ongoing adventure, I suggest this page at TechDirt with lots of articles on Dotcom, otherwise wait for the movie.  I am sure that someone is going to do one soon.

However, I wonder how many others remember “Megabox” and Mr. Dotcom’s pledge to take down the modern music industry?

RIAA Lobbyist, Drafter of DMCA, Now Judge in Patent Troll Cases

Yeah, you read the headline right.  While I am not surprised to hear about such a tactic, I am still appalled.  According to Mike Masnick at TechDirt:

We’ve written about judge Beryl Howell a few times before. She’s the recently-appointed judge whose immediate job prior to that was as a lobbyist for the RIAA. Before that, she worked for the Judiciary Committee and was apparently a key player in drafting the DMCA. It seems pretty damn clear that she holds a strong viewpoint on the nature of copyright law and copyright infringement — but that hasn’t stopped her from taking those cases, even when her rulings appear to be exactly the opposite of nearly every other court. For example, while most courts have been throwing out copyright trolling lawsuits for improper joinder, Judge Howell had no problem with the practice and ordered various ISPs to cough up names based solely on IP addresses.

I wonder if the Pussy Riot trails inspired any of this sham version of justice?  Honestly, judges, lawyers, and politicians, this is why the public is becoming more and more sympathetic to organizations like Anonymous.  If the “legitimate” government and court systems become a scam only to serve lobbyist, corporations, and the élite, should you not expect a revolution?  How could this judge, having any semblance of mental stability, NOT remove himself from the case due to a conflict of interest? Are we supposed to believe that this is some type of justice and not simply a guise for corporate coersion and collection?

You see, I’ve never really thought of myself as a “hero” Just a decent human being.
